The information regarding the description, unit price, quantity and payment terms of the Products is stated below, and this information has also been approved by the Consumer.4.2. If the Seller fails to fulfill this obligation, the Consumer may terminate the agreement.6.2. If the Products are to be delivered to a person other than the Consumer designated by the Consumer, the Seller cannot be held responsible if the person/organization to whom the delivery is to be made refuses to accept the delivery.6.3. The Consumer is obliged to inspect the Products upon receipt and immediately notify the Seller of any defects observed.ARTICLE 7 RIGHT OF WITHDRAWAL7.1 In distance contracts concerning the sale of goods, the Consumer may exercise the right of withdrawal within 14 (fourteen) days from the date the Product is delivered to the Consumer or to the person/organization at the address indicated by the Consumer, without assuming any legal or criminal liability and without providing any reason, by rejecting the goods and withdrawing from the agreement.7.2 To exercise the right of withdrawal, written notification must be submitted to the Seller by registered mail, electronic mail or fax within the 14 (fourteen)-day period.7.3 In order to process the return, the return form sent to you must be completed in full and placed inside the return package, and the return form must also be completed via {storeUrl}.7.4 The Products to be returned must be delivered together with their box, packaging and, if any, standard accessories.7.5 The Seller is obliged to refund the total amount and the documents creating an obligation for the Consumer within a maximum of 14 (fourteen) days from the receipt of the withdrawal notification. ORDERING PARTY: The natural or legal person who requests a good or service through the website belonging to the SELLER,

AGREEMENT: This Agreement concluded between the SELLER and the BUYER,

3. SUBJECT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product ordered electronically by the BUYER through the website belonging to the SELLER, whose specifications and sales price are stated below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

9. GENERAL PROVISIONS

9.1. The BUYER accepts, declares and undertakes that they have read and become informed about the preliminary information regarding the basic characteristics, sales price and payment method of the product subject to the Agreement and delivery, as provided on the website belonging to the SELLER, and that they have provided the necessary confirmation electronically. The BUYER accepts, declares and undertakes that, by confirming the Preliminary Information electronically, prior to the conclusion of the distance sales agreement, they have correctly and completely obtained the address, the basic characteristics of the products ordered, the prices of the products including taxes, and the payment and delivery information that must be provided to the BUYER by the SELLER.

9.2. Each product subject to the Agreement shall be delivered to the BUYER or to the person and/or organization at the address designated by the BUYER within the period specified in the preliminary information section of the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 120 days (The Withdrawal Period must be exercised after 60 days; if exercised earlier, a 20% deduction will be made and shipping costs shall be borne by the customer). If the product cannot be delivered to the BUYER within this period, the BUYER reserves the right to terminate the Agreement. (The Withdrawal Period must be exercised after 60 days; if exercised earlier, a 20% deduction will be made and shipping costs shall be borne by the other party.)

9.3. The SELLER accepts, declares and undertakes to deliver the product subject to the Agreement completely, in accordance with the specifications stated in the order, together with warranty certificates, user manuals and information and documents required by the nature of the transaction, if applicable; to perform the transaction in a sound and standard-compliant manner, free from all defects, in accordance with the requirements of applicable legislation and in accordance with the principles of accuracy and good faith; to maintain and improve service quality; and to exercise the necessary care and attention and act with prudence and foresight during the performance of the transaction.

9.4. The SELLER may supply a different product of equal quality and price by informing the BUYER and obtaining their explicit approval before the fulfillment period arising from the Agreement expires.

9.5. If it becomes impossible to fulfill the ordered product or service and the SELLER cannot fulfill its obligations under the Agreement, the SELLER accepts, declares and undertakes to notify the consumer in writing within 3 days from the date it becomes aware of such impossibility and to refund the total amount to the BUYER within 14 days.

9.6. The BUYER accepts, declares and undertakes that they will confirm this Agreement electronically for the delivery of the product subject to the Agreement and that, if the price of the product subject to the Agreement is not paid for any reason and/or is cancelled in the bank records, the SELLER's obligation to deliver the product subject to the Agreement shall terminate.

9.7. If, after the product subject to the Agreement has been delivered to the BUYER or to the person and/or organization at the address designated by the BUYER, the relevant bank or financial institution does not pay the price of the product subject to the Agreement to the SELLER as a result of the unauthorized use of the BUYER's credit card by unauthorized persons, the BUYER accepts, declares and undertakes to return the product subject to the Agreement to the SELLER within 3 days, with the shipping costs borne by the SELLER.

9.8. If the SELLER cannot deliver the product subject to the Agreement within the specified period due to force majeure, such as circumstances arising independently of the will of the parties that are unforeseeable in advance and prevent and/or delay the parties from fulfilling their obligations, the SELLER accepts, declares and undertakes to notify the BUYER. The BUYER shall have the right to request from the SELLER the cancellation of the order, replacement of the product subject to the Agreement with an equivalent product, if available, and/or postponement of the delivery period until the circumstances preventing delivery cease. If the order is cancelled by the BUYER, in cash payments made by the BUYER, the product amount shall be paid to the BUYER in cash and in a single payment within 14 days. For payments made by credit card, the product amount shall be refunded to the relevant bank within 14 days following the cancellation of the order by the BUYER. The BUYER acknowledges, declares and undertakes that the average processing time for the amount refunded to the credit card by the SELLER to be reflected in the BUYER's account by the bank may take 2 to 3 weeks, and since the reflection of this amount in the BUYER's account after its return to the bank is entirely related to the bank's processing procedure, the BUYER shall not hold the SELLER responsible for any possible delays.

9.9. The SELLER has the right to contact the BUYER through the address, e-mail address, landline and mobile telephone numbers and other contact information provided by the BUYER in the registration form on the website or subsequently updated by the BUYER, by letter, e-mail, SMS, telephone call and other means for communication, marketing, notification and other purposes. By accepting this Agreement, the BUYER accepts and declares that the SELLER may conduct the aforementioned communication activities directed toward them.

9.10. The BUYER shall inspect the goods/services subject to the Agreement before receiving them and shall not accept from the shipping company any goods/services that are damaged or defective, such as dented, broken or with torn packaging. The goods/services received shall be deemed to have been received in sound and undamaged condition. After delivery, the obligation to carefully preserve the goods/services belongs to the BUYER. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must be returned.

9.11. If the BUYER and the holder of the credit card used during the order are not the same person, or if a security vulnerability is detected regarding the credit card used in the order before delivery of the product to the BUYER, the SELLER may request the BUYER to provide the identity and contact information of the credit card holder, a statement for the previous month of the credit card used in the order, or a letter from the cardholder's bank confirming that the credit card belongs to the cardholder. The order shall be suspended until the BUYER provides the requested information/documents, and if the aforementioned requests are not fulfilled within 24 hours, the SELLER shall have the right to cancel the order.

9.12. The BUYER declares and undertakes that the personal and other information provided when registering on the website belonging to the SELLER is accurate and truthful, and that they will immediately compensate, in cash and in a single payment, all damages incurred by the SELLER due to the inaccuracy of this information upon the SELLER's first notification.

9.13. The BUYER accepts and undertakes in advance to comply with the provisions of applicable legislation and not to violate them while using the website belonging to the SELLER. Otherwise, all legal and criminal liabilities arising therefrom shall be borne entirely and exclusively by the BUYER.

9.14. The BUYER may not use the website belonging to the SELLER in any way that disrupts public order, violates general morality, disturbs or harasses others, serves an unlawful purpose, or infringes upon the material and moral rights of others. In addition, the member may not engage in activities that prevent or make it difficult for others to use the services, such as spam, viruses, Trojan horses, etc.

9.15. The website belonging to the SELLER may contain links to other websites and/or other content that are not under the control of the SELLER and/or are owned and/or operated by third parties. These links are provided for the convenience of the BUYER and do not constitute an endorsement of any website or the person operating such website, nor do they constitute any guarantee regarding the information contained on the linked website.

9.16. A member who violates one or more of the provisions set forth in this Agreement shall be personally liable both criminally and legally for such violation and shall hold the SELLER harmless from the legal and criminal consequences of such violations. Furthermore, if the matter is brought before legal authorities due to such violation, the SELLER reserves the right to claim compensation from the member for failure to comply with the membership agreement.

10. RIGHT OF WITHDRAWAL

10.1. In the event that the distance contract concerns the sale of goods, the BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date the product is delivered to the BUYER or to the person/organization at the address designated by the BUYER, provided that the SELLER is notified, without assuming any legal or criminal liability and without providing any reason, by rejecting the goods and withdrawing from the Agreement. For distance contracts concerning the provision of services, this period begins on the date the Agreement is signed. The right of withdrawal cannot be exercised in service contracts where performance has commenced with the consumer's approval before the withdrawal period has expired. The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER. By accepting this Agreement, the BUYER acknowledges in advance that they have been informed about the right of withdrawal.

10.2. To exercise the right of withdrawal, written notification must be submitted to the SELLER by registered mail, fax or e-mail within a period of 60 (sixty) days, and the product must not have been used in accordance with the provisions of this Agreement regarding \"Products for Which the Right of Withdrawal Cannot Be Exercised\". (If a return is made before 60 days, a 20% deduction will be applied and shipping costs shall be borne by the other party.)

In the event that this right is exercised:

a) The invoice of the product delivered to the third party or the BUYER. (If the invoice for the product intended to be returned is issued in the name of a company, it must be returned together with the return invoice issued by the company. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)

b) Return form,

c) The box, packaging and, if any, standard accessories of the products to be returned must be delivered complete and undamaged.

d) The SELLER is obliged to refund the total amount and the documents creating an obligation for the BUYER within a maximum of 10 days from the receipt of the withdrawal notification and to receive the returned goods within 20 days.

e) If the value of the goods decreases or the return becomes impossible due to a reason caused by the BUYER, the BUYER shall compensate the SELLER for the damages incurred by the SELLER to the extent of the BUYER's fault. However, the BUYER shall not be responsible for changes or deterioration resulting from the proper use of the goods or product during the withdrawal period.

f) If the exercise of the right of withdrawal causes the purchase to fall below the campaign limit amount determined by the SELLER, the discount amount benefited from under the campaign shall be cancelled.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products prepared according to the BUYER's request or clearly personal needs and unsuitable for return, undergarment bottoms, swimwear and bikini bottoms, cosmetics, single-use products, goods that are liable to deteriorate rapidly or may expire, products that are unsuitable for return for health and hygiene reasons if their packaging has been opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated by their nature, goods related to periodical publications such as newspapers and magazines other than those provided under a subscription agreement, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and sound or visual recordings, books, digital content, software programs, data recording and storage devices, and computer consumables if their packaging has been opened by the BUYER, as return is not possible pursuant to the Regulation.

Furthermore, pursuant to the Regulation, the right of withdrawal cannot be exercised for services whose performance has commenced with the consumer's approval before the withdrawal period has expired.

Cosmetic and personal care products, underwear products, swimwear, bikini products, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must have unopened, unused, undamaged and untested packaging in order to be eligible for return.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults while making payment by credit card, the BUYER accepts, declares and undertakes that they will pay interest and remain liable to the bank within the framework of the credit card agreement between the cardholder and the bank. In such a case, the relevant bank may initiate legal proceedings and may demand the resulting expenses and attorney's fees from the BUYER. In all cases, if the BUYER defaults on their debt, the BUYER accepts, declares and undertakes to pay the damages and losses incurred by the SELLER due to the delayed performance of the debt.

13. COMPETENT COURT

In disputes arising from this Agreement, complaints and objections shall be submitted to the consumer arbitration committee or consumer court at the place where the consumer resides or where the consumer transaction was carried out, within the monetary limits specified in the relevant legislation. The information regarding the monetary limits is as follows:

Effective as of 28/05/2014:

a) Pursuant to Article 68 of the Consumer Protection Law No. 6502, for disputes with a value below 2,000.00 (two thousand) TL, applications shall be made to district consumer arbitration committees,

b) For disputes with a value below 3,000.00 (three thousand) TL, applications shall be made to provincial consumer arbitration committees,

c) In provinces with metropolitan municipality status, applications shall be made to provincial consumer arbitration committees for disputes with a value between 2,000.00 (two thousand) TL and 3,000.00 (three thousand) TL.

This Agreement is concluded for commercial purposes.

14. EFFECTIVENESS

When the BUYER makes the payment for the order placed through the Site, they shall be deemed to have accepted all terms of this Agreement. The SELLER is obliged to make the necessary software arrangements on the website to obtain confirmation from the BUYER that this Agreement has been read and accepted before the order is completed.

Sözleşme konusu her bir ürün, 120 günlük (Çayma Süresi 60 günden sonra yapılmalıdır, öncesi olursa %20 kesinti ve nakliye müşteri tarafından karşılanır) yasal süreyi aşmamak kaydı ile ALICI' nın yerleşim yeri uzaklığına bağlı olarak internet sitesindeki ön bilgiler kısmında belirtilen süre zarfında ALICI veya ALICI'nın gösterdiği adresteki kişi ve/veya kuruluşa teslim edilir. Bu süre içinde ürünün ALICI'ya teslim edilememesi durumunda, ALICI'nın sözleşmeyi feshetme hakkı saklıdır. (Çayma Süresi 60 günden sonra yapılmalıdır, öncesi olursa %20 kesinti ve nakliye müşteri tarafından karşılanır)9.3. SATICI, Sözleşme konusu ürünü eksiksiz, siparişte belirtilen niteliklere uygun ve varsa garanti belgeleri, kullanım kılavuzları işin gereği olan bilgi ve belgeler ile teslim etmeyi, her türlü ayıptan arî olarak yasal mevzuat gereklerine göre sağlam, standartlara uygun bir şekilde işi doğruluk ve dürüstlük esasları dâhilinde ifa etmeyi, hizmet kalitesini koruyup yükseltmeyi, işin ifası sırasında gerekli dikkat ve özeni göstermeyi, ihtiyat ve öngörü ile hareket etmeyi kabul, beyan ve taahhüt eder.9.4. SATICI, sözleşmeden doğan ifa yükümlülüğünün süresi dolmadan ALICI'yı bilgilendirmek ve açıkça onayını almak suretiyle eşit kalite ve fiyatta farklı bir ürün tedarik edebilir.9.5. SATICI, sipariş konusu ürün veya hizmetin yerine getirilmesinin imkânsızlaşması halinde sözleşme konusu yükümlülüklerini yerine getiremezse, bu durumu, öğrendiği tarihten itibaren 3 gün içinde yazılı olarak tüketiciye bildireceğini, 14 günlük süre içinde toplam bedeli ALICI'ya iade edeceğini kabul, beyan ve taahhüt eder.9.6. ALICI, Sözleşme konusu ürünün teslimatı için işbu Sözleşme'yi elektronik ortamda teyit edeceğini, herhangi bir nedenle sözleşme konusu ürün bedelinin ödenmemesi ve/veya banka kayıtlarında iptal edilmesi halinde, SATICI'nın sözleşme konusu ürünü teslim yükümlülüğünün sona ereceğini kabul, beyan ve taahhüt eder.9.7. ALICI, Sözleşme konusu ürünün ALICI veya ALICI'nın gösterdiği adresteki kişi ve/veya kuruluşa tesliminden sonra ALICI'ya ait kredi kartının yetkisiz kişilerce haksız kullanılması sonucunda sözleşme konusu ürün bedelinin ilgili banka veya finans kuruluşu tarafından SATICI'ya ödenmemesi halinde, ALICI Sözleşme konusu ürünü 3 gün içerisinde nakliye gideri SATICI'ya ait olacak şekilde SATICI'ya iade edeceğini kabul, beyan ve taahhüt eder.9.8. SATICI, tarafların iradesi dışında gelişen, önceden öngörülemeyen ve tarafların borçlarını yerine getirmesini engelleyici ve/veya geciktirici hallerin oluşması gibi mücbir sebepler halleri nedeni ile sözleşme konusu ürünü süresi içinde teslim edemez ise, durumu ALICI'ya bildireceğini kabul, beyan ve taahhüt eder. ALICI da siparişin iptal edilmesini, sözleşme konusu ürünün varsa emsali ile değiştirilmesini ve/veya teslimat süresinin engelleyici durumun ortadan kalkmasına kadar ertelenmesini SATICI'dan talep etme hakkını haizdir. ALICI tarafından siparişin iptal edilmesi halinde ALICI'nın nakit ile yaptığı ödemelerde, ürün tutarı 14 gün içinde kendisine nakden ve defaten ödenir. ALICI'nın kredi kartı ile yaptığı ödemelerde ise, ürün tutarı, siparişin ALICI tarafından iptal edilmesinden sonra 14 gün içerisinde ilgili bankaya iade edilir. ALICI, SATICI tarafından kredi kartına iade edilen tutarın banka tarafından ALICI hesabına yansıtılmasına ilişkin ortalama sürecin 2 ile 3 haftayı bulabileceğini, bu tutarın bankaya iadesinden sonra ALICI'nın hesaplarına yansıması halinin tamamen banka işlem süreci ile ilgili olduğundan, ALICI, olası gecikmeler için SATICI'yı sorumlu tutamayacağını kabul, beyan ve taahhüt eder.9.9. SATICININ, ALICI tarafından siteye kayıt formunda belirtilen veya daha sonra kendisi tarafından güncellenen adresi, e-posta adresi, sabit ve mobil telefon hatları ve diğer iletişim bilgileri üzerinden mektup, e-posta, SMS, telefon görüşmesi ve diğer yollarla iletişim, pazarlama, bildirim ve diğer amaçlarla ALICI'ya ulaşma hakkı bulunmaktadır. ALICI, işbu sözleşmeyi kabul etmekle SATICI'nın kendisine yönelik yukarıda belirtilen iletişim faaliyetlerinde bulunabileceğini kabul ve beyan etmektedir.9.10. ALICI, sözleşme konusu mal/hizmeti teslim almadan önce muayene edecek; ezik, kırık, ambalajı yırtılmış vb. hasarlı ve ayıplı mal/hizmeti kargo şirketinden teslim almayacaktır. Teslim alınan mal/hizmetin hasarsız ve sağlam olduğu kabul edilecektir. Teslimden sonra mal/hizmetin özenle korunması borcu, ALICI'ya aittir. Cayma hakkı kullanılacaksa mal/hizmet kullanılmamalıdır. Fatura iade edilmelidir.9.11. ALICI ile sipariş esnasında kullanılan kredi kartı hamilinin aynı kişi olmaması veya ürünün ALICI'ya tesliminden evvel, siparişte kullanılan kredi kartına ilişkin güvenlik açığı tespit edilmesi halinde, SATICI, kredi kartı hamiline ilişkin kimlik ve iletişim bilgilerini, siparişte kullanılan kredi kartının bir önceki aya ait ekstresini yahut kart hamilinin bankasından kredi kartının kendisine ait olduğuna ilişkin yazıyı ibraz etmesini ALICI'dan talep edebilir. ALICI'nın talebe konu bilgi/belgeleri temin etmesine kadar geçecek sürede sipariş dondurulacak olup, mezkur taleplerin 24 saat içerisinde karşılanmaması halinde ise SATICI, siparişi iptal etme hakkını haizdir.9.12. ALICI, SATICI'ya ait internet sitesine üye olurken verdiği kişisel ve diğer sair bilgilerin gerçeğe uygun olduğunu, SATICI'nın bu bilgilerin gerçeğe aykırılığı nedeniyle uğrayacağı tüm zararları, SATICI'nın ilk bildirimi üzerine derhal, nakden ve defaten tazmin edeceğini beyan ve taahhüt eder.9.13. ALICI, SATICI'ya ait internet sitesini kullanırken yasal mevzuat hükümlerine riayet etmeyi ve bunları ihlal etmemeyi baştan kabul ve taahhüt eder. Aksi takdirde, doğacak tüm hukuki ve cezai yükümlülükler tamamen ve münhasıran ALICI'yı bağlayacaktır.9.14. ALICI, SATICI'ya ait internet sitesini hiçbir şekilde kamu düzenini bozucu, genel ahlaka aykırı, başkalarını rahatsız ve taciz edici şekilde, yasalara aykırı bir amaç için, başkalarının maddi ve manevi haklarına tecavüz edecek şekilde kullanamaz. Ayrıca, üye başkalarının hizmetleri kullanmasını önleyici veya zorlaştırıcı faaliyet (spam, virus, truva atı, vb.) işlemlerde bulunamaz.9.15. SATICI'ya ait internet sitesinin üzerinden, SATICI'nın kendi kontrolünde olmayan ve/veya başkaca üçüncü kişilerin sahip olduğu ve/veya işlettiği başka web sitelerine ve/veya başka içeriklere link verilebilir. Bu linkler ALICI'ya yönlenme kolaylığı sağlamak amacıyla konmuş olup herhangi bir web sitesini veya o siteyi işleten kişiyi desteklememekte ve Link verilen web sitesinin içerdiği bilgilere yönelik herhangi bir garanti niteliği taşımamaktadır.9.16. İşbu sözleşme içerisinde sayılan maddelerden bir ya da birkaçını ihlal eden üye işbu ihlal nedeniyle cezai ve hukuki olarak şahsen sorumlu olup, SATICI'yı bu ihlallerin hukuki ve cezai sonuçlarından ari tutacaktır. Ayrıca; işbu ihlal nedeniyle, olayın hukuk alanına intikal ettirilmesi halinde, SATICI'nın üyeye karşı üyelik sözleşmesine uyulmamasından dolayı tazminat talebinde bulunma hakkı saklıdır.10. CAYMA HAKKI10.1. ALICI; mesafeli sözleşmenin mal satışına ilişkin olması durumunda, ürünün kendisine veya gösterdiği adresteki kişi/kuruluşa teslim tarihinden itibaren 14 (on dört) gün içerisinde, SATICI'ya bildirmek şartıyla hiçbir hukuki ve cezai sorumluluk üstlenmeksizin ve hiçbir gerekçe göstermeksizin malı reddederek sözleşmeden cayma hakkını kullanabilir. Hizmet sunumuna ilişkin mesafeli sözleşmelerde ise, bu süre sözleşmenin imzalandığı tarihten itibaren başlar. Cayma hakkı süresi sona ermeden önce, tüketicinin onayı ile hizmetin ifasına başlanan hizmet sözleşmelerinde cayma hakkı kullanılamaz. Cayma hakkının kullanımından kaynaklanan masraflar SATICI' ya aittir. ALICI, iş bu sözleşmeyi kabul etmekle, cayma hakkı konusunda bilgilendirildiğini peşinen kabul eder.10.2. Cayma hakkının kullanılması için 60 (altmış) günlük süre içinde SATICI' ya iadeli taahhütlü posta, faks veya eposta ile yazılı bildirimde bulunulması ve ürünün işbu sözleşmede düzenlenen \"Cayma Hakkı Kullanılamayacak Ürünler\" hükümleri çerçevesinde kullanılmamış olması şarttır. (60 gün öncesi iade olursa %20 kesinti ve nakliye karşı tarafa aittir.) Bu hakkın kullanılması halinde,a) 3. kişiye veya ALICI' ya teslim edilen ürünün faturası, (İade edilmek istenen ürünün faturası kurumsal ise, iade ederken kurumun düzenlemiş olduğu iade faturası ile birlikte gönderilmesi gerekmektedir. Faturası kurumlar adına düzenlenen sipariş iadeleri İADE FATURASI kesilmediği takdirde tamamlanamayacaktır.)b) İade formu,c) İade edilecek ürünlerin kutusu, ambalajı, varsa standart aksesuarları ile birlikte eksiksiz ve hasarsız olarak teslim edilmesi gerekmektedir.d) SATICI, cayma bildiriminin kendisine ulaşmasından itibaren en geç 10 günlük süre içerisinde toplam bedeli ve ALICI'yı borç altına sokan belgeleri ALICI' ya iade etmek ve 20 günlük süre içerisinde malı iade almakla yükümlüdür.e) ALICI' nın kusurundan kaynaklanan bir nedenle malın değerinde bir azalma olursa veya iade imkânsızlaşırsa ALICI kusuru oranında SATICI' nın zararlarını tazmin etmekle yükümlüdür. Ancak cayma hakkı süresi içinde malın veya ürünün usulüne uygun kullanılması sebebiyle meydana gelen değişiklik ve bozulmalardan ALICI sorumlu değildir.f) Cayma hakkının kullanılması nedeniyle SATICI tarafından düzenlenen kampanya limit tutarının altına düşülmesi halinde kampanya kapsamında faydalanılan indirim miktarı iptal edilir.11. CAYMA HAKKI KULLANILAMAYACAK ÜRÜNLERALICI'nın isteği veya açıkça kişisel ihtiyaçları doğrultusunda hazırlanan ve geri gönderilmeye müsait olmayan, iç giyim alt parçaları, mayo ve bikini altları, makyaj malzemeleri, tek kullanımlık ürünler, çabuk bozulma tehlikesi olan veya son kullanma tarihi geçme ihtimali olan mallar, ALICI'ya teslim edilmesinin ardından ALICI tarafından ambalajı açıldığı takdirde iade edilmesi sağlık ve hijyen açısından uygun olmayan ürünler, teslim edildikten sonra başka ürünlerle karışan ve doğası gereği ayrıştırılması mümkün olmayan ürünler, Abonelik sözleşmesi kapsamında sağlananlar dışında, gazete ve dergi gibi süreli yayınlara ilişkin mallar, Elektronik ortamda anında ifa edilen hizmetler veya tüketiciye anında teslim edilen gayrimaddi mallar, ile ses veya görüntü kayıtlarının, kitap, dijital içerik, yazılım programlarının, veri kaydedebilme ve veri depolama cihazlarının, bilgisayar sarf malzemelerinin, ambalajının ALICI tarafından açılmış olması halinde iadesi Yönetmelik gereği mümkün değildir. Ayrıca Cayma hakkı süresi sona ermeden önce, tüketicinin onayı ile ifasına başlanan hizmetlere ilişkin cayma hakkının kullanılması da Yönetmelik gereği mümkün değildir.Kozmetik ve kişisel bakım ürünleri, iç giyim ürünleri, mayo, bikini, kitap, kopyalanabilir yazılım ve programlar, DVD, VCD, CD ve kasetler ile kırtasiye sarf malzemeleri (toner, kartuş, şerit vb.) iade edilebilmesi için ambalajlarının açılmamış, denenmemiş, bozulmamış ve kullanılmamış olmaları gerekir.12. TEMERRÜT HALİ VE HUKUKİ SONUÇLARIALICI, ödeme işlemlerini kredi kartı ile yaptığı durumda temerrüde düştüğü takdirde, kart sahibi banka ile arasındaki kredi kartı sözleşmesi çerçevesinde faiz ödeyeceğini ve bankaya karşı sorumlu olacağını kabul, beyan ve taahhüt eder. Bu durumda ilgili banka hukuki yollara başvurabilir; doğacak masrafları ve vekâlet ücretini ALICI'dan talep edebilir ve her koşulda ALICI'nın borcundan dolayı temerrüde düşmesi halinde, ALICI, borcun gecikmeli ifasından dolayı SATICI'nın uğradığı zarar ve ziyanını ödeyeceğini kabul, beyan ve taahhüt eder13. YETKİLİ MAHKEMEİşbu sözleşmeden doğan uyuşmazlıklarda şikayet ve itirazlar, aşağıdaki kanunda belirtilen parasal sınırlar dâhilinde tüketicinin yerleşim yerinin bulunduğu veya tüketici işleminin yapıldığı yerdeki tüketici sorunları hakem heyetine veya tüketici mahkemesine yapılacaktır. Parasal sınıra ilişkin bilgiler aşağıdadır:28/05/2014 tarihinden itibaren geçerli olmak üzere:a) 6502 sayılı Tüketicinin Korunması Hakkında Kanun'un 68. Maddesi gereği değeri 2.000,00 (ikibin) TL'nin altında olan uyuşmazlıklarda ilçe tüketici hakem heyetlerine,b) Değeri 3.000,00(üçbin)TL' nin altında bulunan uyuşmazlıklarda il tüketici hakem heyetlerine,c) Büyükşehir statüsünde bulunan illerde ise değeri 2.000,00 (ikibin) TL ile 3.000,00(üçbin)TL' arasındaki uyuşmazlıklarda il tüketici hakem heyetlerine başvuru yapılmaktadır.İşbu Sözleşme ticari amaçlarla yapılmaktadır.14. The brand design, logo, clothing designs, website design, product images, product videos and texts belong to the SAFIR OPTIK brand and may not be used without permission. All of our clothing designs are registered. In the event of any unauthorized use, SAFIR OPTIK will exercise its legal rights. Our Company reserves the right to make any changes it deems necessary regarding matters such as privacy, personal data retention, use and destruction policies, Site terms of use, as well as the products, services, opportunities, campaigns, etc. offered to customers-members. It has been prepared pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (“KVKK”) and other relevant legislation for the purpose of informing and enlightening natural persons during the acquisition of personal data and obtaining consent regarding the processing of personal data. Üye; dilediği zaman Kanun kapsamında Veri Sorumlusu Şirket’e başvurarak kendisine ait kişisel verilerin işlenip işlenmediğini öğrenme, işlenen kişisel verileri varsa bunlara ilişkin bilgi talep etme, kişisel verilerin işlenme amacını ve bu verilerin amaca uygun kullanılıp kullanılmadığını öğrenme, kişisel verilerinin aktarıldığı üçüncü kişileri bilme, kişisel verilerindeki hataların düzeltilmesini ve eğer aktarım yapılmışsa ilgili üçüncü kişiden bu düzeltmenin istenmesini talep etme, kişisel verilerin işlenmesini gerektiren sebeplerin ortadan kalkması halinde bu verilerin silinmesini, yok edilmesini ya da anonim hale getirilmesini isteme ve eğer aktarım yapılmışsa bu talebin aktarılan üçüncü kişiye iletilmesini isteme, İşlenen verilerin neticesinde kişi ile ilintili olumsuz bir sonuç çıkmasına itiraz etme, Kanun’a aykırı veri işleme nedeniyle zararının ortaya çıkması halinde zararını yasalar çerçevesinde talep etme hakkına sahiptir.

Kişisel verilerinizin işlenme amaçları; KVKK’nın 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları dahilinde Şirketimiz tarafından sunulan ürün ve hizmetlerden sizleri faydalandırmak için gerekli çalışmaların iş birimlerimiz tarafından yapılması; sunulan ürün ve hizmetlerin müşterilerimizin beğeni, kullanım alışkanlıkları ve ihtiyaçlarına göre özelleştirilerek müşterilerimize önerilmesi için gerekli çalışmaların yapılması; Şirketimiz tarafından yürütülen birebir ve/veya entegre pazarlama faaliyetleri, satış ve satış sonrası operasyonlar, web sitesi/mobil uygulamalar üzerinden alışveriş yapanın/yaptıranın kimlik bilgilerini teyit etmek, iletişim için adres ve diğer gerekli bilgileri kaydetmektir.

Kişisel veriler ilgili mevzuatlar kapsamında SAFIR OPTIK’ın, sözleşmeye dayansın dayanmasın her türlü faaliyeti kapsamında işlenecektir.

Kişisel veriler, e-ticaret faaliyetlerinin yürütülmesi amacıyla gerçek ve tüzel kişilerle, hissedarlarımızla, doğrudan / dolaylı yurtiçi/yurtdışı iştiraklerimizle; aracılık / acentelik sıfatı ile faaliyetlerini yürüttüğü şirketlerle ve resmi/idari makamlar ile SAFIR OPTIK’ın hizmet aldığı ya da hizmet almayı planladığı kişilerle paylaşılabilecektir.

Kişisel veriler, Kişisel Verilerin Korunması Kanunu ile iş bu bilgilendirme ve muvafakat formu ve kanuna ve/veya sözleşmeye istinaden işlenmektedir.

SAFIR OPTIK bültenine kaydolursanız, belirtilen e-posta adresinize düzenli olarak ürün önerileri/güncelemeleri alacaksınız. Bu bağlamda SAFIR OPTIK, açık rızanıza istinaden kişisel verilerinizi aşağıdaki konular ile ilgili size bilgi vermek amacıyla kullanabilir:

- Promosyonlarımız

- Ürün yelpazemiz

- Markalarımıza ve dikkatle seçilmiş güvenilir iş ortaklarımıza ilişkin promosyonlara ve diğer programlarımıza ilişkin duyurular

- Tarafımızca düzenlenen yarışma, organizasyon, anket ve oylamalar

- Müşteri memnuniyeti uygulamaları ve benzeri pazarlama faaliyetleri vb.

Bu teklifler, geçmiş siparişlerinizden yola çıkılarak oluşturulabilir. Bültenleri gönderirken iki aşamalı onay prosedürü kullanmaktayız; şöyle ki, size gönderdiğimiz bildiri e-postasındaki bağlantıya tıklayarak bülten hizmetini etkinleştirmezseniz size bülten göndermemekteyiz.

SAFIR OPTIK’dan reklam veya bülten almak istemezseniz bu duruma, her reklam e-postasında yer alan üyelikten çıkma bağlantısına tıklayarak ya da bize bir e-posta göndererek işbu Gizlilik Politikasında yer alan iletişim kanalları ile her zaman itiraz edebilirsiniz.

Bizden tanıtım e-postası alma seçimini iptal etseniz dahi, sipariş, satın alma, ziyaretiniz hakkındaki geri bildirimler ve sizinle iletişime geçmek amacıyla ve kanunen izin verilen diğer istisnai haller kapsamında kişisel verilerinizi kullanmaya devam edeceğimizi lütfen unutmayın.

Verisi işlenen kişi SAFIR OPTIK’a başvurarak kendisiyle ilgili;

a) Kişisel veri işlenip işlenmediğini öğrenme,

b) Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,

c) Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,

ç) Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,

d) Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,

e) 7.maddede öngörülen şartlar çerçevesinde kişisel verilerin silinmesini veya yok edilmesini isteme,

f) (d) ve (e) bentleri uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,

g) İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,

ğ) Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme, haklarına sahiptir.

Bu sebeple,

Sitemize üye olduğunda sizden zorunlu olarak; Ad, Soyad, cinsiyet, mail adresi

Üyelik bilgilerini güncellemek istediğinde; Doğum tarihi,

Satın alma işlemi sırasında; Telefon numarası, adres bilgilerini istiyoruz.

Bunların haricinde daha iyi hizmet verebilmek için sunucularımız otomatik olarak; ip adresi, kullandığın tarayıcı ve dilleri kaydeder. Bunların bir kısmı üyelik için zorunlu olan, bir kısmı ise siz müşterilerimizi daha iyi tanıyarak ileride size en uygun hizmeti verebilmemizi sağlayacak bilgilerdir.

C) VERİLERİN KORUNMASI

Ziyaretçiler/Üyeler tarafından verilen/taraflarından edinilen bilgilerin ve işlemlerin güvenliği için gerekli önlemler bilgi ve işlemin mahiyetine göre Şirketimiz veya ilgili kuruluşça sistemlerde ve internet altyapısında, teknolojik imkânlar ve maliyet unsurları dâhilinde, uygun teknik ve idari yöntemler ile alınmıştır.

Sitemizi kullanımlarınızda (varsa) tüm kredi kartı işlemleri ve onayları Şirketimiz'den bağımsız olarak ilgili Banka veya Kart Kuruluşlarınca online olarak aranızda gerçekleştirilmekte olup Kredi kartı \"şifresi\" gibi bilgiler Şirketimiz tarafından görülmez ve kaydedilmez.

Sitemize üyelik, (varsa) ürün/hizmet satın alma ve bilgi güncelleme amaçlı girilen bilgiler, keza kredi kartı ve banka kartlarına ait gizli bilgiler, diğer internet kullanıcıları tarafından görüntülenemez.

D) KİŞİSEL VERİ TOPLAMANIN YÖNTEMİ VE HUKUKİ SEBEBİ

www.safiroptik.com.tr web sitesinden işlem yapan müşterilerimizin verdikleri veriler, müşterilerimizin rızaları ve mevzuat hükümleri uyarınca SAFIR OPTIK tarafından elektronik ortamda toplanmaktadır. Yukarıda belirtilen hukuki sebeplerle toplanan kişisel veriler 6698 sayılı Kanun’un 5. ve 6. maddelerinde belirtilen kişisel veri işleme şartları ve amaçları kapsamında bu Aydınlatma Metni’nin 2. maddesinde belirtilen amaçlarla işlenebilmektedir. Kişisel Veri Sahibinin KVKK’nın 11. Maddesinde Sayılan Hakları

MADDE 11- (1) Herkes, veri sorumlusuna başvurarak kendisiyle ilgili;

a) Kişisel veri işlenip işlenmediğini öğrenme,

b) Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,

c) Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,

F) GİZLİLİK POLİTİKASI DEĞİŞİKLİKLERİ

Gizlilik politikalarımız ile ilgili değişiklik yapma kararı aldığımızda bunu öncelikle web sitemiz üzerinden duyurur, ardından SAFİR OPTİK bayilerine mail yolu ile haber veririz.
